Rare stamp may be sealed in Florida ballot box

An absentee ballot was mailed with what may have been a rare stamp worth as much as $200,000 -- the famous Inverted Jenny -- but the envelope is in a box that by law can't be opened.

Broward County Commissioner John Rodstrom discovered the stamp while reviewing absentee ballots. There was no name on the envelope, so the vote didn't count.

What looked like a small stamp collection on one envelope caught Rodstrom's eye about 8 p.m. Tuesday. At least one was from 1936, Rodstrom said. Then he noticed one had an upside-down World War I-era airplane -- the hallmark of an Inverted Jenny.

"I was a stamp collector when I was little," Rodstrom told The Miami Herald. "I recognized it."

Rodstrom discussed the stamp with other members of the canvassing board, and a stamp-collecting Broward County sheriff's deputy overheard them talking about the possible Jenny.

He said the stamp would be very valuable if it was real. But it was too late.

"By that time we had already sealed the box. And once you seal the box, under the election law you can't unseal it," Broward County Court Judge Eric Beller said.

Elections officials will retain the ballot for 22 months, Jenny Nash, a spokeswoman for the Florida secretary of state's office, told The Associated Press. After that, any action is up to the county elections supervisor.

A telephone message left with Fred Bellis, the executive assistant to Broward County Supervisor of Elections Brenda Snipes, was not immediately returned Saturday.

Snipes' spokeswoman, Mary Cooney, said the supervisor is too busy with balloting to focus on the stamp. Cooney said ballots and materials are usually destroyed after the 22-month holding period.

"She's (Snipes) not going to be able to take any time to even look at it until after the (ballot) certification on Monday," Cooney told the South Florida Sun-Sentinel.

Maynard Guss, president of the Sunrise Stamp Club, said an Inverted Jenny, if authentic, could be worth $200,000. But when the ballot was mailed the stamp was canceled, reducing its value. Guss estimated a canceled Jenny would likely sell for $20,000 to $100,000.

The 24-cent Jenny stamps were printed in 1918. Sheets were run through presses twice to process all the colors and on one pass, four went through backward. Inspectors caught the errors on three sheets and destroyed them, but somehow, a sheet of 100 stamps got through.

Stamp collectors have spent 88 years trying to find them all.

Pogue and Mossberg on the Zune experience

After having already seen photo galleries, video walkthroughs, and endless spec sheets focused on Microsoft's upcoming Zune player, there's no real need to hear Walt Mossberg's and David Pogue's take on the attempted iPod-assassin -- but we'd be lying if we said that we had absolutely no interest in learning the opinions of two of the day's most influential tech journalists with regard to one of the most hyped consumer electronics products of the year. In their thorough write-ups, both Pogue and Mossberg tell us what we pretty much already knew about the device, and which can best be summed up by this variation on a famous political retort: "Mr. Ballmer, I served with the iPod; I knew the iPod; the iPod was a friend of mine. Mr. Ballmer, your Zune is no iPod."

Specifically, each of these esteemed reviewers found the Zune lacking in terms of portability ("The Zune looks big and blocky, sort of like a prototype for a gadget, rather than a finished product," said Mossberg), battery life (less than the iPod's, or even Microsoft's own claims), and content selection (there are currently no movies, TV shows, or podcasts available on the Zune Marketplace, although a last-minute deal with Universal does bulk up the offerings somewhat). Furthermore, Zune's one potential "iPod-killing" feature -- music sharing over WiFi -- is judged to be a complete dud; instead of truly helping the consumer discover new music, Pogue opines that "you can't shake the feeling that it's all just a big plug for Microsoft's music store." Mossberg goes on to knock the Marketplace's point system -- you can only buy points in $5 blocks -- and both gentlemen lament the dearth of accessories and the perceived "screw you" to all parties who have already invested in the PlaysForSure microcosm.

So, is there nothing positive to say about the ol' Zune? Of course not: the device gets high marks for its smooth syncing, polished GUI, intuitive navigation, ability to dock with an Xbox 360, and solid build quality. The problem is, these niceties don't outweigh the missing or frustrating features -- so although it may be a decent player on its own merits, it falls far short in the inevitable comparisons to Apple's darling. Still, we're reminded once again that this is only the first generation of Microsoft's entry into portable audio hardware, and like so many other products from Redmond, it promises to only get better with time.

RIAA Piracy Damages Questioned in Ruling

In a case that could have serious implications for future music piracy lawsuits, a New York District Judge ruled Thursday that a defendant's motion to argue the current statutory damage structure used in the case is unconstitutional may go forward.

Universal Music Group and several other labels are suing Brooklyn, New York resident Marie Lindor, and are attempting to collect a $750 per-song penalty. However, Lindor's attorneys argue that the demand is excessive.

"The statutory damages sought by plaintiffs are unconstitutionally excessive and disproportionate to any actual damages that may have been sustained, in violation of the Due Process Clause," her attorneys said in a filing.

Judge J. Trager agreed, noting that the amount is some 1,071 times the actual damages suffered, which are approximately 70 cents per song. "[The plaintiffs] can cite to no case foreclosing the applicability of the due process clause to the aggregation of minimum statutory damages proscribed under the Copyright Act," he wrote in his ruling.

"A court may extend its current due process jurisprudence prohibiting grossly excessive punitive jury awards to prohibit the award of statutory damages mandated under the Copyright Act if they are grossly in excess of the actual damages suffered," Trager added.

The ruling now forces the recording industry to both produce witnesses and documents on the wholesale price of music downloads. Such documents could for the first time give a look into how much money the music industry is making from online music.

The RIAA had not publicly commented on the case as of press time.

Ed Bradley, Pathbreaking Journalist and Voice of Jazz at Lincoln Center, Dies at 65

Veteran CBS journalist Ed Bradley, who was also the longtime radio announcer for Jazz at Lincoln Center, died yesterday at age 65 of complications from leukemia, CBS News announced

Bradley was one of the first prominent African-American broadcasters and a longtime correspondent for CBS's popular 60 Minutes program, which he joined in 1981. His reports won 11 Emmy Awards, a Peabody Award, a Robert F. Kennedy Journalism Award, and the Paul White Award from the Radio and Television News Directors Association.

His last report for the show was a major interview with suspects and witnesses involved in the alleged rape case involving the Duke University lacrosse team.

During his career, Bradley interviewed such personalities as Michael Jordan, Michael Jackson, Muhammad Ali and Timothy McVeigh. His television portrait of jazz legend Lena Horne — which alternated Horne's performances with his interview — won Bradley his first Emmy.

Bradley was born on June 22, 1941 and grew up working class in Philadelphia. He earned an education degree in 1964 from Cheyney State College then took a job teaching sixth grade. A jazz buff, Bradley also worked as a jazz disc jockey at night, making $1.50 an hour spinning the records of John Coltrane, Miles Davis and Billie Holiday.

In an interview conducted in 2004, the website All About Jazz quotes Bradley as saying that it was "Teach Me Tonight," from Errol Garner's Concert by the Sea. that turned him onto jazz.

"I've been around jazz all my life," Bradley said. "But up to a certain point I regarded it as my father's music and my uncle's music, because they all played it and it was what they liked. But it wasn't my music."

The Garner album, which he heard at 15, was his "Rosetta stone. Because I never got jazz. It was something the generation ahead of me listened to. It wasn't my music. I didn't understand it. Then all of a sudden I heard Concert by the Sea. Particularly 'Teach Me Tonight.' All of sudden it made sense to me."

Both for financial reasons and to indulge his wanderlust, Bradley decided to focus on becoming a journalist. He was hired by CBS News as a stringer in 1971 and sent to Saigon during the Vietnam War; he was wounded during an assignment in adjacent Cambodia.

Bradley joined Jazz at Lincoln Center in 1991, where served as the host of the organization's radio broadcasts.

Wynton Marsalis, artistic director of Jazz at Lincoln Center, said in a statement, "Ed Bradley was a great American, one of our definitive cultural figures, a man of unsurpassed curiosity, intelligence, dignity and heart. We of course are shocked and experiencing that unspeakable grief that always attends the finality of the death of a loved one. We have lost a trusted friend and mentor. Our nation has lost a voice of integrity and wisdom. We love him and miss him and it will always be that way."

Norah Jones | Not Too Late

Norah Jones' new album, Not Too Late, will be released on 30th January 2007. For the first time ever, all of the songs are either written or co-written by Norah, who sings and plays piano and guitar. The CD, Norah's third solo effort for Blue Note, follows her 2002 debut Come Away With Me and 2004's Feels Like Home. Jones says that Not Too Late, produced by her boyfriend and bandmember Lee Alexander in his home studio in New York, is more personal than her previous efforts since she had a hand in composing all of the CD's songs.

The CD features guitarists Adam Levy and Jesse Harris, keyboardist Larry Goldings, drummer Andy Borger, saxophonist Bill McHenry, vocalist and flutist Daru Oda, cellist Julia Kent and cellist Jeff Zeigler of the classical-jazz group Kronos Quartet. Song titles are the title track, "Until the End," "Rosie"s Lullaby," "Be My Somebody," "Sinkin' Soon," "Thinking About You," "Little Room," "The Broken," "Wake Up," "Wish I Could," "My Dear Country" and "The Sun Doesn't Like You."
