RIAA Wins $675k in Damages From File Swapper

A Boston student has been ordered to pay US$675,000 to the recording industry for illegal file-sharing, according to reports Friday.

Joel Tenenbaum had admitted to downloading and sharing digital music. Judge Nancy Gertner of the U.S. District Court for Massachusetts found him guilty of infringement and left the jury to decide damages.

They were instructed to charge him between $750 and $30,000 for each song he downloaded and distributed. On Friday, the jury decided he should pay $22,500 per song, according to Ars Technica.

The verdict had not been posted online late Friday and Tenenbaum's lawyer did not immediately return a call for comment.

The ruling comes a month-and-a-half after another file sharer, Jammie Thomas-Rasset, was also ordered to pay up for infringement. She was initially asked to pay $220,000 but won a retrial, after which a Minnesota jury ordered her to pay $1.92 million, or $80,000 per song. She plans to appeal the decision.

The Recording Industry Association of America has filed around 20,000 lawsuits against people in a bid to stop online music trading and copyright infringement. Thomas-Rasset was one of the first people to receive a guilty verdict in a case backed by the RIAA. Others have settled their suits.

Late last year the RIAA said it would stop filing new lawsuits against individuals for file-trading, but it continues to litigate cases it had already filed.

In a statement Friday the RIAA said it was grateful for the jury's recognition of the impact illegal downloading has on the music industry.

John Patitucci Trio - "Remembrance" August 4th

Given that jazz bass players are typically cast as part of the rhythm support team, only a handful of them have become leaders in their own right. Taking the lead from such jazz masters as Charles Mingus, Ray Brown, Ron Carter and Dave Holland who pioneered the advance of the bass, the next generation of acoustic and electric bassists have been crafting musical statements in leadership roles.

At the top of that class is acoustic and electric bassist John Patitucci, who delivers his latest Concord Jazz project, Remembrance, a remarkable outing of 11 straight-ahead-to-funky-to-classical-tinged originals featuring an astounding trio comprising saxophone maestro Joe Lovano and brilliant drummer Brian Blade. Almost every tune is dedicated to a musician, hence the title. The CD is the bassist's 13th as a leader and seventh for Concord, with which he made his debut in 1997 with One More Angel. Guests include his wife Sachi Patitucci on cello and percussionist Rogerio Boccato, who delivers simpatico rhythms with Blade on four tracks that Patitucci says makes them sound "like one giant organism."

"It's not an easy thing for a bass player to be able to lead his own group and record today," says Patitucci, who, in addition to being a leader, is a longstanding member of saxophonist Wayne Shorter's quartet (along with Blade) as well as a regular participant in trios led by drummers Roy Haynes and Jack DeJohnette. He adds, "Our musical elders were the trailblazers who forged a path for us to follow."

As for the trio that he has assembled, Patitucci says that this particular group is a dream band for him, which makes Remembrance a special recording. "I've been waiting for years to make a trio record like this," he says. "Brian is a consummate artist whose contributions go way beyond the drums. He's powerful, and he has great interpretive skills, incredible ears and a breadth of musicality. Joe improvises at such a high level, and he brings a great sound, phrasing and overall feeling to everything he plays on."

Both players, says Patitucci, "swing hard and can change directions on a dime. I chose guys that I felt I could be vulnerable enough with to take lots of chances in the music." Lovano and Blade also recorded with Patitucci on his 2001 Communion Concord Jazz album, but in a quartet setting with pianist Brad Mehldau. During one rehearsal that Mehldau had to miss, Patitucci, Lovano and Blade set up shop with revelatory results. "We freaked out," Patitucci says. "We looked at each other and said that we should do a record like this someday. Ever since that time eight years ago, this album has been brewing within me."

With a minimum of overdubs, Remembrance was recorded live in the studio in the same room, with none of the players listening through headphones. "I wanted it to sound organic and let the bass bleed into other things Joe and Brian were doing," Patitucci says. "Plus, my bass sound was able to be a little bigger, broader and warmer versus

The final song selections for Love Is The Answer, the eagerly awaited new studio collection of intimate jazz standards performed by Barbra Streisand, are being revealed in anticipation of the album's release on Tuesday, September 29.

The first full-length collection of new studio recordings from eight-time Grammy award winner Barbra Streisand since 2005's Guilty Pleasures, Love Is The Answer showcases the artist as a singer of emotional clarity, depth and maturity, offering the listener a selection of late night meditations on love's powers, heartbreaks and solaces.

Love Is The Answer provides an opportunity for Streisand to work for the first time with the Grammy-winning Canadian jazz artist Diana Krall and her quartet (piano, guitar, bass, drums) who bring a refined and sensual poignancy to the album's sophisticated and subtle accompaniments.

Rounding out the album's smoky after-hours ambience with his sublime orchestrations is the legendary songwriter ("The Shadow of Your Smile") and Grammy-winning arranger Johnny Mandel (who worked with Streisand on her 1993 Back to Broadway album and arranged/co-produced Krall's 1998 Grammy-winning When I Look In Your Eyes).

The deluxe version of Love Is The Answer is a two-disc package that features the Mandel arranged orchestra versions on disc one and quartet counterparts on disc two featuring Barbra accompanied only by quartet (piano, bass, guitar & drums).

"Make Someone Happy," a song from the 1960s musical "Do Re Mi," with lyrics by Comden and Green and music by Jule Styne, who wrote the music for Streisand's breakout performance in "Funny Girl."

"If You Go Away (Ne Me Quitte Pas)" - A quintessential version of the Jacques Brel standard performed in English and French.

"Gentle Rain" a gentle bossa nova from "Black Orpheus," the motion picture which introduced the world to the rhythms of Brazilian music.

"Smoke Gets In Your Eyes," the quintessential dreamy standard, originally written as a show tune by Jerome Kern and Otto Harbach for the 1933 operetta "Roberta," covered by Nat "King" Cole and the Platters, among others.

"Some Other Time," a rarely-covered gem composed by Leonard Bernstein with lyrics by Comden and Green from the 1944 musical "On The Town."

Terence Blanchard. "Choices" 8/18

Concord Jazz is proud to announce the signing of three-time Grammy award winning trumpet player and composer Terence Blanchard. With more than 29 albums to his credit, Blanchard has established himself as one of the most influential jazz musicians and film score composers of his generation. Blanchard’s new album Choices will be released on August 18, 2009.

Blanchard’s legacy has helped shaped the contours of modern jazz. As a musician he is a multi-Grammy Award winner, most recently winning earlier this year for his instrumental solo for “Be-Bop” on Live At The 2007 Monterey Jazz Festival. In addition to receiving the award, Blanchard performed live on the Grammy telecast along with other New Orleans artists including Lil’ Wayne, Allen Toussaint and the Dirty Dozen Brass Band and singer Robin Thicke. In 2008, Blanchard won a Grammy for his CD, A Tale of God's Will (A Requiem for Katrina), a beautifully haunting and impassioned song cycle about Hurricane Katrina and the ravages incurred upon the City of New Orleans and its residents.

Blanchard’s Concord debut, Choices, was recorded in his hometown of New Orleans at the Ogden Museum of Art. The album addresses the choices we all make in life – both as a society and on a personal level. Blanchard will premiere the project at the Ogden in late July, and the show will be filmed for an upcoming documentary. Accompanying Blanchard on the album are longstanding band members Fabian Almazan on piano, Derrick Hodge on bass, Kendrick Scott on drums, Lionel Loueke on guitar and newcomer Walter Smith lll on saxophone, all of whom significantly contributed to the album's compositions. Guest artists on Choices include writer, speaker, educator and activist Dr. Cornel West and singer, musician and composer Bilal. West performs spoken word pieces on the album with Bilal providing vocals on several of the tracks.

"It's good to be back where I originally started my career. I'm excited about the possibilities of working with a staff that has the same passion for music and creativity as I do. At Concord , I feel we both look forward to an exciting future of creating new traditions in jazz," said Terence.

Bob James & Earl Klugh Celebrate The 30 Year Anniversary Of The Release Of Their Grammy Award Winning CD "One On One"

Contemporary Jazz legends Bob James and Earl Klugh will reunite for a week at the Blue Note to celebrate the 30 year anniversary of their 1979 GRAMMY® winning, platinum-selling collaboration, One On One. With a total of nearly 70 full-length albums recorded independently by Klugh and James, their award-winning discographies are impressive and diverse.

The career of Bob James is long, varied and continues to evolve at every turn. From his first days of piano recital in Marshall, Missouri to his own trio while at the University of Michigan to New York City and beyond, the music of Bob James has captivated audiences throughout the world.

Discovered by Quincy Jones at the Notre Dame Jazz Festival in 1963, Bob recorded his first solo album, Bold Conceptions, that year for Mercury Records. 36 more solo albums would follow through four decades; that number is just to date and does not include his Grammy award winning collaboration projects. Although he was to record another trio album, Explosions, for ESP (1964), it was not until Bob met up with Creed Taylor in New York that his composing, arranging and recording career really took off. After working on albums for CTI artists like Hank Crawford, Grover Washington, Jr. and many others, Bob finally recorded his own album, One. This introduced his music to a bigger audience and launched a lifelong career of recording and performing live. There were to be three more CTI albums before Bob moved to CBS in the 1970's and began his own label, Tappan Zee Records. It was during this time that he recorded his own gold seller, Touchdown, which included his composition, Angela, Theme from 'Taxi.' Bob composed all the original music used in that television series for its entire run. One On One, the first in three collaborations with Earl Klugh, was awarded a Grammy in 1980 and has sold over a million copies. A different aspect of the musical talent of Bob James was demonstrated on his three classical albums recorded for the CBS Masterworks division, the first of which was Rameau released in 1984.

In 1985 Bob moved to Warner Bros Records and began that association with another million seller and Grammy winner, Double Vision, his collaboration with David Sanborn, produced by Tommy LiPuma. It was in 1990 while recording his Grand Piano Canyon album that Bob reunited with his old friend, drummer Harvey Mason, Jr. and worked for the first time with Lee Ritenour on guitar and Nathan East on bass. The sessions for this project were the genesis of the group, Fourplay. Their first album was recorded and released in 1991. They have gone on to record four more albums, with Larry Carlton taking over on guitar in 1998 in time for album number and title, 4.

On April 7, Bob was awarded the George Benson Lifetime Achievement Award by the Canadian Smooth Jazz Awards. The award and tribute were presented in Toronto to Bob By his longtime friend and musical colleague, Alexander Zonjic.

For over three decades and to this very day, the name Earl Klugh is synonymous with “Guitar Legend.” He maintains a loyal and devoted fan base, touring all over the US and the world, playing music that is beautiful, lyrical, elegant and eternally cool and classy.

In 2007, Klugh introduced his concert series, Night of Guitars, featuring fellow guitar legends Bill Frisell, Russell Malone, Ray Parker Jr. and Peter White. He has toured India twice with the sponsorship of the U.S. State Department and The Thelonious Monk Institute of Jazz. In early April 2008, Klugh presented his 5th Annual Weekend of Jazz at the Broadmoor Resort in Colorado Springs, CO, joining world-renowned peers Ramsey Lewis, Boney James, Mindi Abair and fellow KOCH labelmate Sophie Milman.

Jeff Golub "Blues For You" - 8/25

The band recorded this album live at Skyline Recording Studio in Manhattan in about four days, with special guests floating in and out. There is not one fade out ending on the entire record. "Not that we always had a prearranged ending," Golub says. "You can hear how the band is following each other. This can only happen recording a live band made up of musicians who are really listening."

Golub has released 6 solo albums and 3 albums as the leader of the instrumental band Avenue Blue. Before becoming an instrumentalist, Jeff worked as a sideman to a number of very successful rock and pop artists.

Manhattan Transfer to Perform Benefit Concert for the Society of Singers

The legendary vocal group Manhattan Transfer is performing a benefit concert for the Society of Singers, which is celebrating its 25th anniversary this year. The show will take place on the evening of September 11, at the El Portal Theatre in North Hollywood at 8:00 pm with premium tickets including a pre-concert reception.

The Manhattan Transfer, which consists of Tim Hauser, Janis Siegel, Alan Paul and Cheryl Bentyne, was founded more than 35 years ago by Hauser, who dreamed of blending jazz, R&B, pop, rock 'n' roll, salsa and swing into a vocal group without limits. The group has released more than two dozen albums, enjoyed 18 charting singles (including the Top 10 pop hit "The Boy from New York City") and won eight Grammy Awards in a variety of categories; in 1981, they became the first group to win Grammys in both pop and jazz categories in a single year. Four Quarters Entertainment will release Manhattan Transfer's new CD entitled The Chick Corea Songbook in September.

The Society of Singers was founded by Chairman Emeritus Ginny (Mrs. Henry) Mancini and Gilda Maiken Anderson when the two friends, both of them former professional singers, realized that many of their friends and colleagues were without pensions, unions, medical insurance or places to turn for financial help during tough times. With the help of donations from private and corporate sponsors, SOS works to meet the emergency needs of applicants who have earned their primary living as singers for five years or more. SOS also awards scholarships to students pursuing their education in the vocal arts.

The benefit concert will take place at the El Portal Theatre, 5269 Lankershim Boulevard in North Hollywood, on Friday, September 11, 2009.
